This website is operated by Canada VHS. Throughout the site, the terms “we,” “us,” and “our” refer to Canada VHS.

By visiting our website and/or purchasing something from us, you agree to these Terms of Service, along with any additional policies referenced on our website, including our Return & Refund Policy and Shipping Policy.

If you do not agree to these terms, please do not use the website or purchase products from us.

1. Online Store Terms

By using this website, you represent that you are legally capable of entering into a purchase agreement in your jurisdiction.

2. Products and Vintage Media

Canada VHS primarily sells used, vintage, collectible, and out-of-print physical media.

Because many of our products are decades old, items may show signs of age and previous ownership, including shelf wear, case wear, stickers, labels, writing, fading, cosmetic imperfections, or other characteristics associated with used vintage media.

We make reasonable efforts to accurately photograph, identify, and describe our products.

Unless otherwise stated, VHS tapes and other vintage media are not represented as being in new or pristine condition.

Please review product descriptions, photographs, and our Return & Refund Policy before purchasing.

3. Product Availability

Many products sold by Canada VHS are individual used items with a quantity of one.

Adding an item to your cart does not necessarily reserve it. An item may remain available to other customers until checkout has been successfully completed.

Inventory errors can occasionally occur. If an item you purchased cannot be located, has been damaged, was incorrectly listed as available, or otherwise cannot be fulfilled, we may cancel the affected item or order and issue a refund.

4. Prices

All prices displayed on our website are subject to change without notice.

We reserve the right to correct pricing, description, inventory, or other listing errors.

If a material pricing error is discovered after an order has been placed, we may contact you for instructions or cancel and refund the affected item.

Applicable taxes and shipping charges are calculated as indicated during checkout.

5. Orders

We reserve the right to refuse, limit, or cancel an order when reasonably necessary, including in cases involving suspected fraud, payment problems, inventory errors, pricing errors, abuse of promotions, resale activity that interferes with normal store operations, or other unusual circumstances.

If we cancel an order after payment has been collected, the applicable amount will be refunded.

6. Payment

Payment must be successfully authorized before an order can be fulfilled.

Payment processing may be provided by third-party payment providers. Your use of those payment methods may also be subject to the provider's terms and policies.

We do not guarantee that every payment method will remain available at all times.

7. Shipping and Delivery

Orders are processed and shipped according to our Shipping Policy.

Processing time and carrier transit time are separate.

Delivery dates provided by carriers or displayed during checkout are estimates unless expressly stated otherwise.

Canada VHS is not responsible for carrier delays or other delivery disruptions outside our reasonable control, although we will make reasonable efforts to assist customers when shipping problems occur.

8. Returns and Refunds

Returns, damaged items, defective products, cancellations, and refunds are governed by our Return & Refund Policy.

Because we sell vintage and used physical media, normal age-related wear or characteristics clearly disclosed through photographs or descriptions are not considered product defects.

9. Accuracy of Information

We make reasonable efforts to provide accurate information, but errors may occasionally occur.

Product titles, release information, editions, years, studios, descriptions, pricing, availability, photographs, categories, and other information may contain mistakes.

If you believe a listing contains an error, please contact us.

10. Third-Party Services

Our website may use or link to services operated by third parties, including payment processors, shipping carriers, ecommerce platforms, analytics providers, and other service providers.

We are not responsible for the content, availability, policies, or practices of independent third-party websites or services.

11. Intellectual Property

The Canada VHS name, branding, original website design elements, original written content, photography created by us, and other original materials on this website may not be reproduced or commercially exploited without permission.

Movie titles, artwork, characters, trademarks, logos, packaging, and other intellectual property associated with the vintage products we sell remain the property of their respective rights holders.

Canada VHS sells legitimate physical media and does not claim ownership of the underlying films, programs, artwork, trademarks, or other third-party intellectual property represented on those products.

12. Prohibited Uses

You may not use this website to engage in unlawful activity; attempt unauthorized access to our systems; transmit malicious code; scrape or systematically harvest website content in a manner that disrupts the service; impersonate another person; submit fraudulent information; interfere with another customer's use of the website; or otherwise misuse our services.

We may restrict access to the website when reasonably necessary to protect our customers, business, or systems.

13. Disclaimer

Our website and services are provided on an “as available” basis to the extent permitted by applicable law.

Vintage media inherently varies in condition and performance. We do not warrant that used VHS tapes will provide playback quality equivalent to modern or newly manufactured media.

Nothing in these Terms of Service is intended to exclude or limit rights or remedies that cannot legally be excluded under applicable Canadian consumer-protection law.

14. Limitation of Liability

To the extent permitted by applicable law, Canada VHS will not be liable for indirect, incidental, special, or consequential losses arising from the use of our website, products, or services.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

15. Indemnification
